By accessing or using FileUp ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, you may not use the Service. These terms apply to all visitors, users, and others who access or use FileUp.
We reserve the right to update or modify these terms at any time without prior notice. Your continued use of the Service following any changes constitutes your acceptance of the revised terms. It is your responsibility to review these terms periodically.
FileUp provides an anonymous, ephemeral file-sharing platform. You may use the Service to upload files up to 2GB in size and share the generated link with others. Each uploaded file is automatically and permanently deleted after 168 hours (7 days).
You agree to use the Service only for lawful purposes. You are solely responsible for the content you upload and share. You must not use the Service to upload, store, or distribute any material that is illegal, harmful, threatening, abusive, harassing, defamatory, obscene, or otherwise objectionable.
You may not use the Service to distribute malware, spyware, ransomware, or any other malicious software. Automated uploads via scripts or bots are permitted within reasonable rate limits, but any attempt to abuse, overload, or disrupt the Service infrastructure is strictly prohibited.
You retain all ownership rights to the files you upload. By uploading content to FileUp, you grant us a limited, non-exclusive, royalty-free license to store and serve the file solely for the purpose of providing the Service.
We do not access, view, or analyze the contents of your uploaded files except as required by law or to investigate a report of a violation of these terms. We do not sell, share, or transfer your content to third parties.
All uploaded content is automatically deleted after 7 days. We do not maintain backups of user-uploaded files beyond the active serving period.
The following types of content are strictly prohibited on FileUp:
Content that is illegal under applicable local, national, or international law. Child sexual abuse material (CSAM) or any content that sexually exploits minors. Content that facilitates violence, terrorism, or hate crimes. Copyrighted material uploaded without the rights holder's permission. Personal data of individuals uploaded without their consent. Malware, viruses, exploits, or any software designed to cause harm.
We reserve the right to remove any content that violates these prohibitions and to report such content to the appropriate authorities.
FileUp respects intellectual property rights. If you believe that content uploaded to our Service infringes your copyright, please send a DMCA takedown notice to [email protected] with the following information: a description of the copyrighted work, the URL of the allegedly infringing file, your contact information, and a statement of good faith belief that the use is not authorized.
We will process valid DMCA notices promptly and remove infringing content. Repeat infringers may be banned from the Service.
The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not warrant that the Service will be uninterrupted, error-free, or free of viruses or other harmful components.
We make no representations or warranties regarding the reliability, accuracy, or availability of the Service. Your use of the Service is at your sole risk. We are not responsible for any loss of data, including files that may be lost due to system failure or early deletion.
To the maximum extent permitted by applicable law, FileUp and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service.
This includes, without limitation, loss of profits, loss of data, loss of goodwill, service interruption, computer damage, or system failure, even if we have been advised of the possibility of such damages. Our total liability to you for any claim arising out of or relating to these terms or the Service shall not exceed the amount you paid us in the 12 months preceding the claim, if any.
We reserve the right to suspend or terminate access to the Service at any time, for any reason, with or without notice. Reasons for termination may include violation of these terms, abuse of the Service, or actions we reasonably believe harm other users or the integrity of the platform.
Upon termination, your right to use the Service ceases immediately. Any files you have uploaded will be deleted in accordance with our standard 7-day policy or sooner at our discretion.
These terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
Any dispute arising out of or relating to these terms or the Service shall be resolved exclusively in the state or federal courts located in Delaware. You consent to the personal jurisdiction of such courts and waive any objection to venue.
